Liability Waiver & Release
Shag Class LLC Last Updated: September 18, 2026
1. What This Document Is
This Liability Waiver & Release ("Waiver") is between you and Shag Class LLC, a South Carolina limited liability company ("Shag Class," "we," "us," or "our"). By creating an account, subscribing, or using any part of the Service (as defined in our Terms of Service), you agree to this Waiver in addition to, not instead of, our Terms of Service.
This Waiver specifically concerns the physical risks of dance instruction. It supplements — and does not replace — the physical activity disclaimer already in Terms of Service §10.
2. Nature of the Activity
Shag Class provides video-based instruction in Carolina Shag, a partner dance. You participate in this activity at your own home or another location of your choosing, watching instructional videos and physically practicing the steps, turns, footwork, and partnering techniques shown. Unlike an in-person dance class, no instructor is present to supervise you, correct your form in real time, or intervene if something goes wrong. You are solely responsible for the physical space you dance in (clear floor, appropriate footwear, adequate lighting, sufficient room to move) and for pacing yourself.
3. Acknowledgment and Assumption of Risk
You acknowledge that partner and solo dancing, like any physical activity, carries inherent risk of injury, including but not limited to:
- Falls, slips, or loss of balance, particularly during turns, spins, and footwork patterns;
- Muscle strains, sprains, or joint injuries (including to the ankles, knees, hips, and back);
- Overexertion, particularly for participants who are not used to regular physical activity;
- Collision with furniture, walls, or other objects in your practice space;
- If practicing with a partner, incidental contact or injury involving that partner.
You voluntarily and knowingly assume all such risks, whether known or unknown to you at this time, arising from your participation in dance activity taught or demonstrated through the Service.
4. Your Fitness to Participate
By using the Service, you represent that:
- You believe yourself to be in good enough physical condition to participate in dance instruction, or have consulted a physician who has cleared you to do so;
- You have no known medical condition that would make participation in moderate physical activity unsafe for you, or if you do, you have consulted your physician before participating;
- You will stop immediately and seek appropriate care if you experience pain, dizziness, shortness of breath, or any other concerning symptom while participating.
Shag Class does not provide medical advice. Nothing in the Service is a substitute for professional medical guidance, and you should consult a physician before beginning any new physical activity, especially if you are pregnant, recovering from injury, or managing a chronic health condition.
5. Release of Liability
To the maximum extent permitted by South Carolina law, you release, waive, and discharge Shag Class LLC, its owners, instructors (including Myers Floyd and Steve Balok), and contractors from any and all liability, claims, demands, or causes of action arising out of or related to any injury, loss, or damage you may sustain while participating in dance activity taught, demonstrated, or inspired by the Service — except to the extent such injury, loss, or damage is caused by Shag Class's gross negligence or willful misconduct.
6. Indemnification
This section restates, in the specific context of physical injury, the general indemnification already in Terms of Service §15: you agree to indemnify and hold harmless Shag Class LLC and its owners, instructors, and contractors from claims brought by a third party (for example, someone you were practicing with) arising from your participation in dance activity through the Service.
7. If You Attend an In-Person Event
This Waiver is written primarily for the at-home, video-based Service described in §2. If Shag Class ever hosts, co-hosts, or is otherwise formally affiliated with an in-person class, workshop, or event (as opposed to Myers's or Steve's own independent appearances, which this Waiver does not cover), a separate or expanded waiver acknowledging the presence of other participants, a physical venue, and possibly an instructor should be used instead of, or in addition to, this one.
8. Governing Law & Severability
This Waiver is governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles, consistent with our Terms of Service. If any provision of this Waiver is found unenforceable, the remaining provisions remain in full force.
9. Acknowledgment
By checking the box at signup (or otherwise using the Service), you confirm that:
- You have read and understood this Waiver in its entirety;
- You are at least 18 years old (per Terms of Service §3);
- You are voluntarily agreeing to assume the risks described above and to release Shag Class LLC as described in §5.
Implementation note for Phase 6 build: this should be a required, separately-labeled checkbox at signup (distinct from the Terms of Service / Privacy Policy checkbox), so there's a clear record that this specific risk acknowledgment was presented and accepted — not just bundled silently into a general "I agree to the Terms" click.
